A judge has determined that Elon Musk’s political organization is permitted to continue distributing $1 million (£722,000) to voters in key swing states. According to a lawyer representing the billionaire, speaking at a court hearing on Monday, the America PAC’s financial distribution is scheduled to conclude on Tuesday, with the ultimate recipient already identified. Contrary to widespread belief, the lawyer disclosed that individuals receiving these funds were not selected through a random, lottery-like competition but rather chosen directly by the group. Philadelphia District Attorney Lawrence Krasner had initiated legal action to halt what he described as “an illegal lottery,” following Mr. Musk’s announcement that he would award money daily to one voter in a swing state leading up to Election Day. The Associated Press reported that Pennsylvania Judge Angelo Foglietta did not immediately provide the rationale for his decision, which was issued several hours subsequent to the hearing. As reported by the Associated Press, attorney Chris Gober stated during the hearing, “The $1m recipients are not chosen by chance.” He further added, “We know exactly who will be announced as the $1m recipient today and tomorrow.” US media outlets conveyed that Mr. Gober informed the court that America PAC has already identified the final recipient as a voter from Michigan. Earlier on Monday, America PAC declared that a man named Joshua in Arizona had received the day’s award. The group also posted on X, the platform formerly known as Twitter and owned by Mr. Musk, stating: “Every day until Election Day, a person who signs will be selected to earn $1m as a spokesperson for America PAC.” However, when the world’s wealthiest individual initially introduced this initiative last month, many presumed it involved a random selection process for registered voters who had endorsed a petition supporting the First and Second Amendments of the US Constitution. Mr. Musk had stated at a campaign event, “We are going to be awarding $1m randomly to people who have signed the petition, every day, from now until the election.” Subsequently, the US Justice Department issued a warning that the group might be violating election statutes, which prohibit compensating individuals for voter registration. Krasner’s office then filed a lawsuit seeking to prevent this. Mr. Musk has actively campaigned for Republican White House contender Donald Trump in various swing states nationwide. His committee has also exerted significant effort in Pennsylvania, where surveys indicate Trump is polling evenly with his Democratic opponent, Vice-President Kamala Harris. However, US media reported that Chris Young, the director of America PAC, testified in court that recipients undergo screening and are required to possess values consistent with those of the group. Reuters indicated that individuals who receive these funds enter into non-disclosure agreements, which prevent them from publicly discussing the specifics of their contracts. Mr. Musk was not present at Monday’s hearing. Additionally on Monday, Joe Rogan launched a podcast episode featuring an interview with Mr. Musk lasting almost three hours. In a post on X promoting the podcast, Rogan declared his endorsement of former President Donald Trump.
