A judge stated that the trial of a woman facing charges of illegally aborting her baby ended prematurely because of “appalling and sloppy” reporting from the BBC. Sophie Harvey, 25, and her boyfriend, Elliot Benham, 25, acknowledged purchasing abortion pills via the internet, but Harvey maintained she did not take them. At Gloucester Crown Court in May, the couple faced trial. The jury was subsequently discharged after their lawyers submitted an application, citing inaccurate reporting of the proceedings by BBC Points West. The BBC offered an apology to the court regarding the “unintentional” errors. Testimony in court indicated that the opening headlines of the May 16 Points West episode featured archive footage of a Cirencester, Gloucestershire, property, showing a tent and scenes of crime officers at work, alongside the declaration: “The remains were found in the garden.” Further into the report on that day’s trial proceedings, a television reporter stated that Harvey had taken the pill. Her insistence was that she had given birth to a stillborn child in the bathroom of her Cirencester residence in 2018, and had not ingested an abortion pill. Harvey’s representative, Tom Godfrey, sought the discharge of the jury on account of the reporting, stating that it would affect his client’s credibility, as she continued to assert she did not take the abortion pill. Before dismissing the jury, Judge Ian Lawrie KC described the BBC’s reporting as “appalling and sloppy”. A spokeswoman for the BBC stated: “The BBC apologised to the court for the unintentional errors in some of our reporting of the trial in May 2024. Our apology was accepted by the judge hearing the case.” A new trial was set for February 2025; however, Harvey and Benham admitted guilt to a fresh charge of conspiracy to procure a poison with intent to procure a miscarriage. Additionally, they pleaded guilty to attempting to conceal the birth of a child. An 18-month community order was imposed on Harvey, and Benham was directed to perform 150 hours of unpaid work.
