An appeal by one of the teenagers convicted of murdering 16-year-old Brianna Ghey, seeking a reduction in his sentence, has been denied. Eddie Ratcliffe, along with Scarlett Jenkinson, both 15 at the time, enticed Brianna to a park in Warrington, Cheshire, on 11 February 2023, where they fatally stabbed her in a violent assault. Their conviction for her murder followed a trial at Manchester Crown Court in December last year. Mr. Ratcliffe received a life sentence, with a minimum custodial period of 20 years. However, his legal representatives petitioned the Court of Appeal in London for a reduced term, contending that the trial judge did not adequately consider his “immaturity”. The Crown Prosecution Service (CPS) challenged this appeal attempt, asserting that the sentence was “appropriate” and not “manifestly excessive”. A panel of three senior judges rejected the application, determining that the suggested grounds for appeal were “not arguable.” Lady Chief Justice Baroness Carr, presiding alongside Mr Justice Lavender and Mr Justice Murray, stated: “The judge was then entitled to take into account the aggravating factors as identified.” Richard Littler KC, counsel for Mr. Ratcliffe, informed the court that the adolescent had received diagnoses of autism spectrum disorder and selective mutism. Mr. Littler noted that Mr. Ratcliffe exhibited “poor social skills” and “immaturity,” alongside “a lower-than-expected ability to express what he thinks or articulate his ideas,” and argued that the sentence imposed was “far too high.” He asserted: “There is no doubt they were taken into account, but they were not taken into account fully.” Deanna Heer KC, representing the CPS, described Mr. Ratcliffe’s demeanor towards Brianna as “dehumanising” and characterized the murder as involving “sadistic conduct,” reiterating that the sentence was not “manifestly excessive.” She stated: “Eddie demonstrated himself throughout to be just as enthusiastic about what they were going to do as Scarlett.” Mr. Ratcliffe and Ms. Jenkinson had been acquainted since the age of 11, having both attended Culcheth High School in Warrington. Subsequently, Ms. Jenkinson transferred to Birchwood High School, a nearby institution, where she encountered Brianna. The judge noted that Ms. Jenkinson was determined to be obsessed with death and violence, possessing a “deep desire to kill.” Law enforcement discovered that she had accessed content pertaining to murder and torture on the dark web and had compiled a “kill list” containing the names of four other children before ultimately selecting Brianna as her victim. A handwritten document detailing the murder plot was discovered on Ms. Jenkinson’s bedroom floor, alongside writings about serial killers such as Jeffrey Dahmer, Richard Ramirez, and Harold Shipman. In messages to Mr. Ratcliffe, Ms. Jenkinson expressed her desire to stab Brianna for “fun,” adding: “I want to see the pure horror on her face and hear her scream.” Sentencing judge Mrs. Justice Yip stated that Ms. Jenkinson, who received a minimum term of 22 years, acted as the “driving force” behind the murder scheme, but emphasized that it would have been “wholly wrong to treat [Ratcliffe] as being under Scarlett’s control.” Justice Yip further noted that Mr. Ratcliffe’s motivation stemmed partly from animosity towards Brianna’s transgender identity. On the day of the homicide, Ms. Jenkinson and Mr. Ratcliffe arranged to rendezvous with Brianna at Linear Park, Culcheth. Mr. Ratcliffe brought a hunting knife, which the two individuals employed to stab Brianna 28 times. Both teenagers fled the scene after being interrupted by a couple walking their dog, and authorities apprehended them an hour subsequently. Brianna maintained a significant presence on social media platforms, including TikTok. However, her mother, Esther Ghey, recently informed a coroner’s court that her daughter had contended with mental health challenges. Ms. Ghey recounted that Brianna would occasionally neglect personal hygiene for weeks and experienced complete isolation. The opening of her inquest revealed that Brianna had been diagnosed with an eating disorder and had engaged in self-harm.
