An individual has been sentenced to eight years in prison for torturing another man over a two-day period, after which the victim fatally jumped from a 12th-storey apartment. Lee Smith, aged 37, abducted Jamie Forbes, also 37, and unlawfully detained him at Smith’s residence in Elphinstone Court, Aberdeen, during January. During the assault, Smith repeatedly hit Mr. Forbes with a hammer, in addition to punching and kicking him, prior to Mr. Forbes’ fatal leap. Smith had previously pleaded guilty to culpable homicide and received his sentence at the High Court in Edinburgh. Judge Lady Hood was informed that the abuse inflicted upon Mr. Forbes was so severe that it left him with no alternative but to exit the window. Mr. Forbes’ body was discovered on the ground on 15 January. Leanne McQuillan, acting for the prosecution, informed the court that law enforcement personnel arrived a short time later. Officers found that the apartment’s lock had been tampered with, making it impossible for Mr. Forbes to exit. Smith was found in his kitchen engaged in washing, and bloodstains were present throughout the apartment. Ms. McQuillan stated: “The accused informed the officers that he was refusing to clean up the blood in the living room as it wasn’t his and he was waiting for the deceased to do it.” She further noted that Mr. Forbes was last seen on CCTV entering the building on 14 January. The following morning, a contractor in the vicinity heard a man’s voice calling for the police. Concurrently, a resident living nearby also reported hearing a male repeatedly cry for help, though she was uncertain of its origin. She subsequently contacted 999. A resident residing on the 10th floor heard a male voice repeatedly yelling “please help me”. This individual stepped onto his balcony in an attempt to locate the source of the sound but observed no one. He concluded the shouts were originating from an upper floor. Furthermore, two residents living directly above Smith’s flat also reported hearing calls for assistance. Upon looking down, they observed the window below was open and saw a male requesting help and calling for the police. Several other witnesses observed a male at an apartment window with blood on his face, appealing for help. Additional calls were placed to the police. Ms. McQuillan stated: “Police officers attended and made door-to-door inquiries on the 6th, 7th and 8th floor but were not able to trace the source of the shouting.” They departed the scene, instructing nearby construction workers to contact them again if the shouting resumed. The court was informed that two witnesses entered Smith’s apartment and observed the victim on the living room floor amidst a pool of blood. After they left, Mr. Forbes then jumped from the residence. Ms. McQuillan reported that a post-mortem examination conducted on Mr. Forbes revealed injuries described as “significant and catastrophic”. Defence counsel Brian McConnachie KC commented: “He is under no doubt that only a custodial sentence is appropriate.” He expressed genuine remorse and understanding regarding his actions. Lady Hood informed Smith that imprisonment was necessary for his offenses. She additionally mandated that he be supervised by authorities for four years after his release. While delivering the sentence, the judge conveyed to Smith that family members of the victim had submitted a statement to the court, outlining the profound impact of their loved one’s death. She stated: “I’ve seen a victim impact statement which has been provided to the court by Mr Forbes’ sister.” Lady Hood further noted that the sister had movingly described how cherished Mr. Forbes was and expressed the difficulty in articulating the profound impact of his loss on their lives. Lady Hood stated that no imposed sentence could adequately address the pain and suffering experienced by the sister.
