Brendan Mullin, a former international rugby player, has received a three-year prison sentence for the theft of over €570,000 (£475,602) from Bank of Ireland Private Bank. Mr. Mullin, residing at Stillorgan Road in Donnybrook, Dublin 4, had entered a plea of not guilty to charges of stealing the funds between 2011 and 2013, during his tenure as the bank’s chief executive officer. The 61-year-old also denied accusations of false accounting. A jury found him guilty on 12 of the 14 charges earlier in November, and the court was informed that he now accepts the jury’s decision. During the trial, it was revealed that Mr. Mullin misappropriated €500,000 (£417,193) from Bank of Ireland amid a breakdown in communication within various divisions of the banking group, with the funds subsequently transferred to Spice Holdings. This company, registered in the British Virgin Islands, was a client that Mr. Mullin had introduced to the bank, according to court proceedings. Allegations presented during the trial indicated that Mr. Mullin orchestrated payments from the bank to McCann Fitzgerald solicitors, Beechwood accountants, and Grant Thornton for services rendered either to him personally or to his company, Quantum Investment Strategies. The presiding judge stated that Mr. Mullin held “a position of trust and a position of power” at the time of the theft from the bank. The judge observed that Mr. Mullin did not provide a motive, but inferred that Mr. Mullin was “somewhat desperate for funds and embarked on this endeavour to obtain money.” Several mitigating factors were considered by the judge, including the fact that Bank of Ireland Private Bank had been fully reimbursed for the funds and incurred no loss. The judge also highlighted a considerable delay in initiating the legal proceedings. According to the judge, Mr. Mullin expressed being “remorseful and sorry” for his conduct. Nevertheless, the judge determined that a custodial sentence was unavoidable, imposing a three-year jail term.
