An individual has been sentenced to five years in prison for raping a vulnerable woman whom he lured to his Aberdeen flat after pretending to be a good samaritan. Diego Valdivieso, aged 30, offered the young woman a bed at his residence in the city’s Rosemount area, having encountered her drunk and disoriented on Union Street in October 2022. He was found guilty of raping her while she was asleep and unable to provide or withhold consent. The woman subsequently contacted law enforcement. Valdivieso, an Ecuadorian national, received his sentence at the High Court in Edinburgh and was informed that he would be deported following the completion of his prison term. Lord Lake, the presiding judge, stated that it was evident his victim continued to suffer from the repercussions of his actions. The judge remarked: “You posed as a good Samaritan when she found herself confused in the centre of Aberdeen.” He continued: “You offered her your bed – she was trusting and you took advantage of that when she was drunk.” The judge expressed hope that the conclusion of the trial would assist the woman in her recovery. Valdivieso was permanently added to the sex offenders register.
