Mark Byrne, 51, has been handed a life sentence for fatally stabbing his brother, Paul Byrne, 47, in what was described as “a moment of madness.” He is mandated to serve a minimum of 12 years in custody for striking his brother in the heart. Prior to the incident, the siblings had been watching a Celtic versus Rangers football match at Mark Byrne’s residence in Glenalmond, Glasgow. During the proceedings, a judge characterized the situation as “tragic,” noting that it involved one brother ending the life of another. Lord Cubie, presiding at the High Court in Edinburgh, stated that Byrne had “inexplicably” taken up a knife before attacking his younger brother in the neck and chest. Lord Cubie further addressed Byrne, saying: “You left immediately despite the fact that Paul was lying in a pool of blood.” After a previous trial held at the High Court in Glasgow, Byrne was convicted of his brother’s murder, committed on 1 May 2022, by striking him with a knife. He had earlier admitted guilt to the lesser charge of culpable homicide, but the prosecution declined this plea. During his trial, Byrne, a window cleaner, informed the jury that he was irritated by Paul for yelling at their mother over the phone, but he denied any intention to cause harm. He described the events as a blur. The altercation escalated after the brothers, along with Byrne’s then-partner and a friend, had watched the Old Firm derby draw on television at the older brother’s residence. Byrne had confiscated his younger brother’s phone, leading both men into the kitchen. Paul insisted on retrieving his mobile device, but the confrontation became physical, resulting in him being stabbed in what a witness characterized as a “frenzied” assault. Following the assault, Byrne proceeded to another brother’s home before his arrest. Defence counsel Thomas Ross KC stated that this was Byrne’s initial offence. He noted that Byrne, one of seven siblings, had previously refrained from criminal activity and had contributed positively to society. Mr. Ross remarked: “He knows his actions over those seconds have deprived his mother of a son and his siblings of a brother.” He added: “In every sense it is a tragic situation. It is a moment of madness.” Mr. Ross further stated: “He finds it extremely difficult to come to terms with the fact he was responsible for the death of his brother.
