The Committee for Home Affairs (CHA) reports that a modification to the procedure for managing police complaints in Guernsey has not resulted in any of them being rejected. The CHA indicated that since August, when an alteration was introduced to permit the initial scoping of complaints (defining the parameters for addressing the complaint), law enforcement officials have received 14 complaints. None of these have been dismissed through the updated procedure. According to the committee, two of these were determined to involve gross misconduct or misconduct, three were evaluated as not constituting misconduct, one complaint was retracted, and eight were still in the initial scoping stage. It further stated that this information was disseminated to assure island residents that the police force was not unfairly dismissing grievances. Amendment Regulation 6A grants the relevant authority the ability to review easily accessible information during an early phase to guide decision-making. Deputy Rob Prow, who serves as President of the CHA, commented: “Regulation 6A was identified as a way to ensure those complaints could be scoped early and, if any serious failings were identified, quickly prioritised.” This regulation permits an issue to be sent for dismissal solely if there is justification to conclude that the complainant’s conduct “did not take place, the complaint is repetitious, an abuse of procedures, or is frivolous or vexatious”. Deputy Simon Vermeulen, Vice-President of the CHA, stated that while the police complaints process ought to provide individuals with a method for raising concerns, “it is also fact of life that sometimes the police engage with people who do not welcome that police involvement”. He further remarked: “Just because that is the case does not always mean the police – who work so hard to protect our community – did something wrong,”.
