A legal action concerning alleged health and safety violations against a farm shop enterprise has been dismissed by a judge. Paul Palmer, aged 49, who previously owned Mackenzies Smoked Products, located in Blubberhouses, close to Otley, attended York Crown Court on Thursday. This appearance followed an application by his legal representatives to have the accusations against him set aside. The allegations included claims that the establishment subjected employees to hazardous sewage storage arrangements and lacked adequate safety inspections. Judge Simon Hickey determined that the Health and Safety Executive was the sole authority capable of prosecuting this matter, as opposed to North Yorkshire Council, which had initiated the legal proceedings. Earlier court proceedings revealed that from 30 November 2021 to 21 December 2022, it was alleged that adequate safety measures were not implemented to guarantee the secure fastening of an effluent tank lid at Mackenzies Farm Shop, situated on Woodnook Farm, Blubberhouses, thereby affecting employee safety. Judge Hickey stated: “The application to dismiss must succeed and the Health and Safety Executive must be the proper prosecution authority.“This hearing concerns the issue of whether North Yorkshire Council has the jurisdiction to bring proceedings, and it does have the jurisdiction.“I can’t have any knowledge of what was going on at the premises and it should be the authority who decides whether there was this activity going on.”” Mackenzies Farm Shop underwent liquidation last year, and its website indicates that it has been operating under new management since November 2023. The establishment features a café offering a variety of locally sourced items, such as fresh fruit, vegetables, and meat.
